Terms of Service

Eligibility and authority
You must be at least 18 years old and legally able to enter into these Terms. If you use A / B for an organization, you represent that you have authority to bind that organization.
Your content and rights
You retain the rights you have in questions, alternatives, images, URLs, concepts, research materials, and other content you submit. You grant A / B a limited, non-exclusive license to host, transmit, display to authorized participants, process, secure, analyze, moderate, and otherwise use that content as reasonably necessary to provide the service, enforce these Terms, prevent abuse, comply with law, and protect users and the service. Private or confidential research content is not licensed for unrelated advertising, unrelated model training, or creation of unrelated commercial datasets.
Your responsibilities
You are responsible for the legality, accuracy, rights, permissions, notices, consents, and instructions associated with your tests. You must have all rights needed to submit and disclose the material you provide. You are responsible for determining whether your research requires additional consent, regulatory review, ethics review, accessibility measures, sector-specific notices, or contractual protections.
Prohibited research and content
You may not use A / B to create, distribute, recruit for, or analyze research that is unlawful, fraudulent, deceptive, exploitative, abusive, privacy-invasive, discriminatory, malicious, or rights-infringing. Prohibited content includes sexual exploitation or sexual content involving minors; instructions or solicitation for serious wrongdoing; encouragement of suicide or self-harm; targeted harassment or hateful degradation; collection of passwords, authentication secrets, payment-card numbers, government identifiers, or similarly sensitive credentials through ordinary survey fields; doxxing or unauthorized personal-data collection; malware, phishing, scams, or evasion of security controls; and research designed to make or facilitate unlawful discriminatory decisions in employment, housing, lending, insurance, education, healthcare, or other high-impact areas.
Sensitive and regulated studies
Do not use the standard self-service product to collect protected health information, biometric identifiers, precise geolocation, highly sensitive financial data, information from children, or other regulated sensitive data unless A / B has expressly approved the use case and the required product, contractual, and compliance controls are in place. A / B may require additional review, restrictions, documentation, or a separate agreement for regulated or high-risk research.
Content screening and enforcement
A / B may use automated rules, classifiers, human review, rate limits, fraud signals, and other safeguards to screen questions, options, URLs, images, accounts, and activity for prohibited or high-risk content. We may block publication, limit distribution, suspend a test, quarantine results, reject respondents, remove content, or suspend or terminate access when we reasonably believe content or activity violates these Terms, creates legal or safety risk, threatens service integrity, or requires further review. Automated screening is not guaranteed to identify every violation, and publication does not mean A / B has approved the legality or appropriateness of a study.
Public, unlisted, private, and confidential modes
Public material may be intentionally exposed to the public and, where enabled, search indexing. Unlisted material is accessible to people who possess the link and is not a confidentiality guarantee. Private and Confidential modes may add access restrictions, anti-automation controls, restricted result sharing, and participant acknowledgments. Technical controls reduce risk but cannot guarantee that an authorized person will never remember, photograph, copy, or wrongfully disclose material they were permitted to view.
Confidential Research participant obligations
If you participate in a test marked Confidential Research, you may use the displayed material only to complete the authorized research activity. Unless expressly permitted, you may not copy, download, photograph, screenshot, record, publish, redistribute, disclose, sell, scrape, data-mine, reverse engineer, create a dataset from, or use the material for another commercial or competitive purpose. You may not submit Confidential Research material to an AI system or third-party processor unless the test expressly authorizes that processing.
Automated access and AI restrictions
Except through an interface or agent program expressly authorized by A / B, you may not use bots, crawlers, scrapers, browser agents, data-mining systems, or similar automated means to access, extract, monitor, or collect test content or results. You may not use A / B content to train, fine-tune, ground, benchmark, or improve an AI system unless expressly authorized by A / B and, where applicable, the test creator.
Authorized AI evaluation
A creator may expressly choose to have selected A / B evaluator models or approved third-party AI providers evaluate a test. Choosing human-only research does not authorize transmission of confidential test content to an AI evaluator. AI outputs are probabilistic benchmark signals and may be inaccurate, incomplete, inconsistent, or change over time.
Participants and response integrity
You may not manipulate votes, submit fraudulent responses, create deceptive participant or agent identities, interfere with eligibility controls, bypass sample limits, or attempt to identify respondents who are intended to remain anonymous. A / B may invalidate responses or withhold results affected by suspected fraud, duplication, automation, collusion, or abuse.
Managed respondents and incentives
Where A / B provides or arranges human respondents, eligibility, incidence, pricing, incentives, availability, timing, and completion rates may vary. A / B may use third-party panel or recruitment providers. Unless expressly agreed otherwise, respondent participation does not create an employment relationship between A / B and a respondent or between a creator and a respondent.
Fees, taxes, and billing information
You agree to pay the fees shown at checkout or in an applicable order. Prices may exclude taxes. You are responsible for providing accurate billing and usage-location information, including country, state/province or region, and postal code where requested. A / B may use that information and payment-provider information to determine, collect, remit, or report applicable sales, use, VAT, GST, or similar taxes. If you claim an exemption, you are responsible for providing valid documentation. You remain responsible for taxes imposed on you that A / B is not legally required to collect.
Research results and decisions
Human responses are preferences from the described sample, not guarantees of market outcomes. AI and agent evaluations are benchmark signals, not guarantees of rankings, recommendations, purchasing behavior, regulatory compliance, or future third-party outputs. You are responsible for decisions made from results and should not use A / B as the sole basis for legal, medical, employment, lending, housing, insurance, or other high-impact decisions.
Privacy and data protection
Our Privacy Policy describes how A / B processes personal information. If you submit personal data about others, you represent that you have a lawful basis and all required notices and permissions. Additional data-processing terms may apply where required.
Security
You may not probe, scan, exploit, disrupt, overload, reverse engineer, or circumvent security or access controls except as expressly authorized. You must protect account credentials and promptly notify A / B of suspected unauthorized access.
Suspension, termination, and deletion
We may suspend or terminate accounts, tests, payments, agent access, or other functionality for violations, suspected fraud, legal or safety risk, nonpayment, security incidents, or material operational risk. Creators may request deletion of test content subject to reasonable retention for security, fraud prevention, backups, billing, disputes, and legal obligations. Deletion from A / B systems cannot recall copies independently obtained outside the service.
Third-party services
A / B may rely on third-party infrastructure, authentication, analytics, payment, communications, panel, fraud-prevention, and AI providers. Their services may be governed by separate terms. A / B is not responsible for third-party products or services outside our control.
Disclaimers
To the maximum extent permitted by law, A / B is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. We do not guarantee that content screening, confidentiality controls, fraud detection, sample composition, or research results will be perfect or complete.
Limitation of liability
To the maximum extent permitted by law, A / B and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Our aggregate liability arising out of or relating to the service will not exceed the greater of the amount you paid A / B for the service giving rise to the claim during the 12 months before the event or US$100. Some jurisdictions do not allow certain limitations, so those limitations may not apply to you.
Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless A / B and its affiliates, officers, employees, and providers from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from your content, your research design or recruitment, your violation of these Terms, your violation of law or third-party rights, or your misuse of results.
Changes
We may update these Terms. Material changes will be posted with a new effective date and, where appropriate, additional notice or renewed acceptance. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
