Terms of Service
1. Eligibility, authority, and electronic acceptance
1.1 You must be at least 18 years old and legally able to enter into these Terms. If you use AB Testing for an organization, you represent that you have authority to bind that organization. When you create or complete an account, we may require affirmative electronic acceptance of the current Terms and acknowledgment of the Privacy Policy. We may retain an audit record of that acceptance, including the authenticated account identifier, accepted document versions, acceptance time, and technical request information reasonably necessary to establish the record.
2. Your content and rights
2.1 You retain the rights you have in questions, alternatives, images, URLs, concepts, research materials, and other content you submit. You grant Outland.Work LLC a limited, non-exclusive license to host, transmit, display to authorized participants, process, secure, analyze, moderate, and otherwise use that content as reasonably necessary to provide the service, enforce these Terms, prevent abuse, comply with law, and protect users and the service. Private or confidential research content is not licensed for unrelated advertising, unrelated model training, or creation of unrelated commercial datasets.
3. Your responsibilities
3.1 You are responsible for the legality, accuracy, rights, permissions, notices, consents, and instructions associated with your tests. You must have all rights needed to submit and disclose the material you provide. You are responsible for determining whether your research requires additional consent, regulatory review, ethics review, accessibility measures, sector-specific notices, or contractual protections.
4. Prohibited research and content
4.1 You may not use AB Testing to create, distribute, recruit for, or analyze research that is unlawful, fraudulent, deceptive, exploitative, abusive, privacy-invasive, discriminatory, malicious, or rights-infringing. Prohibited content includes sexual exploitation or sexual content involving minors; instructions or solicitation for serious wrongdoing; encouragement of suicide or self-harm; targeted harassment or hateful degradation; collection of passwords, authentication secrets, payment-card numbers, government identifiers, or similarly sensitive credentials through ordinary survey fields; doxxing or unauthorized personal-data collection; malware, phishing, scams, or evasion of security controls; and research designed to make or facilitate unlawful discriminatory decisions in employment, housing, lending, insurance, education, healthcare, or other high-impact areas.
5. Sensitive and regulated studies
5.1 Do not use the standard self-service product to collect protected health information, biometric identifiers, precise geolocation, highly sensitive financial data, information from children, or other regulated sensitive data unless Outland.Work LLC has expressly approved the use case and the required product, contractual, and compliance controls are in place. Outland.Work LLC may require additional review, restrictions, documentation, or a separate agreement for regulated or high-risk research.
6. Content screening and enforcement
6.1 Outland.Work LLC may use automated rules, classifiers, human review, rate limits, fraud signals, and other safeguards to screen questions, options, URLs, images, accounts, and activity for prohibited or high-risk content. We may block publication, limit distribution, suspend a test, quarantine results, reject respondents, remove content, or suspend or terminate access when we reasonably believe content or activity violates these Terms, creates legal or safety risk, threatens service integrity, or requires further review. Automated screening is not guaranteed to identify every violation, and publication does not mean Outland.Work LLC has approved the legality or appropriateness of a study.
7. Public, unlisted, private, and confidential modes
7.1 Public material may be intentionally exposed to the public and, where enabled, search indexing. Unlisted material is accessible to people who possess the link and is not a confidentiality guarantee. Private and Confidential modes may add access restrictions, anti-automation controls, restricted result sharing, and participant acknowledgments. Technical controls reduce risk but cannot guarantee that an authorized person will never remember, photograph, copy, or wrongfully disclose material they were permitted to view.
8. Confidential Research participant obligations
8.1 If you participate in a test marked Confidential Research, you may use the displayed material only to complete the authorized research activity. Unless expressly permitted, you may not copy, download, photograph, screenshot, record, publish, redistribute, disclose, sell, scrape, data-mine, reverse engineer, create a dataset from, or use the material for another commercial or competitive purpose. You may not submit Confidential Research material to an AI system or third-party processor unless the test expressly authorizes that processing.
9. Automated access and AI restrictions
9.1 Except through an interface or agent program expressly authorized by Outland.Work LLC, you may not use bots, crawlers, scrapers, browser agents, data-mining systems, or similar automated means to access, extract, monitor, or collect test content or results. You may not use AB Testing content to train, fine-tune, ground, benchmark, or improve an AI system unless expressly authorized by Outland.Work LLC and, where applicable, the test creator.
10. Authorized AI evaluation and analysis
10.1 A creator may expressly choose to have selected AB Testing evaluator models or approved third-party AI providers evaluate a test or generate analysis. Choosing human-only research does not by itself authorize AI evaluation. When AI processing is expressly authorized, Outland.Work LLC may transmit the minimum content and instructions reasonably necessary to the selected model routes or providers. AI outputs are probabilistic benchmark signals and may be inaccurate, incomplete, inconsistent, or change over time. Private or confidential customer research is not authorized for unrelated model training merely because the customer selected AI evaluation or AI-generated reporting.
11. Participants and response integrity
11.1 You may not manipulate votes, submit fraudulent responses, create deceptive participant or agent identities, interfere with eligibility controls, bypass sample limits, or attempt to identify respondents who are intended to remain anonymous. Outland.Work LLC may invalidate responses or withhold results affected by suspected fraud, duplication, automation, collusion, or abuse.
12. Managed respondents and incentives
12.1 Where Outland.Work LLC, through AB Testing, provides or arranges human respondents, eligibility, incidence, pricing, incentives, availability, timing, and completion rates may vary. Outland.Work LLC may use third-party panel or recruitment providers. Unless expressly agreed otherwise, respondent participation does not create an employment relationship between A / B and a respondent or between a creator and a respondent.
13. Managed research quotes, fulfillment, and cancellations
13.1 Managed recruiting is subject to feasibility review and a separate quote or order confirmation. Quotes may depend on incidence, quotas, geography, role or industry criteria, sample size, timing, screening requirements, and panel availability. Unless an order says otherwise, a quote is not a guarantee that every requested characteristic or completion date will be achieved. Outland.Work LLC may reject, replace, or exclude responses that fail disclosed quality, eligibility, fraud, duplicate-response, speed, attention, or integrity controls. If assumptions materially change after approval, we may pause work and request approval for revised scope, timing, or pricing. Cancellation, refund, and credit treatment for managed recruiting is governed by the applicable quote or order; amounts already committed to panels, incentives, or completed work may be non-refundable to the extent permitted by law.
14. Fees, taxes, checkout, and billing information
14.1 You agree to pay the fees shown at checkout or in an applicable order. Creating a draft, requesting a managed-audience quote, or reaching a payment screen does not by itself constitute successful payment or publication. Paid access or fieldwork begins only after the service confirms the applicable payment or approved order state. Prices may exclude taxes. You are responsible for providing accurate billing and usage-location information, including country, state/province or region, and postal code where requested. Outland.Work LLC may use that information and payment-provider information to determine, collect, remit, or report applicable sales, use, VAT, GST, or similar taxes. If you claim an exemption, you are responsible for providing valid documentation. You remain responsible for taxes imposed on you that A / B is not legally required to collect.
15. Research results and decisions
15.1 Human responses are preferences from the described sample, not guarantees of market outcomes. AI and agent evaluations are benchmark signals, not guarantees of rankings, recommendations, purchasing behavior, regulatory compliance, or future third-party outputs. You are responsible for decisions made from results and should not use AB Testing as the sole basis for legal, medical, employment, lending, housing, insurance, or other high-impact decisions.
16. Privacy and data protection
16.1 Our Privacy Policy describes how Outland.Work LLC processes personal information, including account, research, response, billing, security, analytics, and legal-acceptance records. If you submit personal data about others, you represent that you have a lawful basis and all required notices and permissions. You must not use the standard product for data that requires a business associate agreement, specialized children's-data terms, or other regulated-data contract unless Outland.Work LLC has expressly agreed to those terms. Additional data-processing terms may apply where required.
17. Security
17.1 You may not probe, scan, exploit, disrupt, overload, reverse engineer, or circumvent security or access controls except as expressly authorized. You must protect account credentials and promptly notify Outland.Work LLC of suspected unauthorized access.
18. Suspension, termination, and deletion
18.1 We may suspend or terminate accounts, tests, payments, agent access, or other functionality for violations, suspected fraud, legal or safety risk, nonpayment, security incidents, or material operational risk. Creators may request deletion of test content subject to reasonable retention for security, fraud prevention, backups, billing, disputes, and legal obligations. Deletion from AB Testing systems cannot recall copies independently obtained outside the service.
19. Third-party services
19.1 Outland.Work LLC may rely on third-party infrastructure, authentication, analytics, payment, communications, panel, fraud-prevention, and AI providers. Their services may be governed by separate terms. A / B is not responsible for third-party products or services outside our control.
20. Disclaimers
20.1 To the maximum extent permitted by law, AB Testing is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. We do not guarantee that content screening, confidentiality controls, fraud detection, sample composition, or research results will be perfect or complete.
21. Limitation of liability
21.1 To the maximum extent permitted by law, Outland.Work LLC and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Our aggregate liability arising out of or relating to the service will not exceed the greater of the amount you paid Outland.Work LLC for the service giving rise to the claim during the 12 months before the event or US$100. Some jurisdictions do not allow certain limitations, so those limitations may not apply to you.
22. Indemnity
22.1 To the extent permitted by law, you will defend, indemnify, and hold harmless Outland.Work LLC and its affiliates, officers, employees, and providers from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from your content, your research design or recruitment, your violation of these Terms, your violation of law or third-party rights, or your misuse of results.
23. Changes
23.1 We may update these Terms. Material changes will be posted with a new effective date and, where appropriate, additional notice or renewed acceptance. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
24. Contact and contracting party
24.1 The contracting party for AB Testing is Outland.Work LLC. Questions about these Terms, enterprise contracting, or reports of prohibited content may be sent through the contact channel identified on the AB Testing site. Enterprise, regulated, or higher-assurance research may require a separate NDA, data-processing agreement, order form, or negotiated agreement with Outland.Work LLC.
